Learned counsel for opposite party No. 1 made a statement that they are ready to refund the amount of the mobile set in question amounting to Rs. 17,100/- to the complainant within 45 days from the receipt of the copy of this order subject to the complainant will hand over the mobile set alongwith all accessories in working condition without any further damage at the time of receiving the amount in question. His statement recorded and taken up on the file.

On the other hand complainant made a statement that he has heard the statement of the counsel for the opposite party No. 1 and agreed with the same and withdraw the present complaint with liberty to file fresh if required. 

In view of the statements of the parties present complaint is dismissed as withdrawn with liberty to the complainant that he can file a fresh complaint if required. Both the parties are bound with their statements made today in this Commission. Copy of the order be supplied to the parties free of costs. File be consigned to the records after due compliance.
