Inspite of fixing this case for passing ex parte order, nobody appears on behalf of the appellant.

This appeal has been filed along with the petition for condoning the delay of about 20 days in filing this appeal.

Learned District Forum has interalia held that the materials available on record do not indicate in any manner that the husband of the Complainant was involved in any criminal activity or had contributed and led to a situation by his own conduct for his murder and therefore the murder of the husband of the Complainant will be an accidental death, covered by the policy.

This view is supported by the judgment passed in the case of Maya Devi reported in III (2008) CPJ 120 (NC).

Therefore, even if the delay the 20 days in filing this appeal is condoned, in our opinion there is no merit in this appeal which is accordingly dismissed.
