    1. The instant case was filed by complainant U/S 12 of the C.P.Act, 1986 wherein the complainant has prayed for direction upon the o.ps. to return the gold weighing 1 vory 6 anas and advance of Rs. 7,000/- and to pay compensation for Rs. 2 lakhs for mental pain and litigation costs of Rs. 50,000/- as the predecessor in interest of the o.ps. in spite of repeated reminders did not manufacture the gold chain as agreed upon.
    2. The present o.ps. filed writtenversion but did not ultimately appear at the time of argument.
    3. Upon pleadings of both parties two points arose for determination :
  • i)          Is there any deficiency in service on the part of the O.Ps.  ?

    1. Whether the complainant isentitled to get any relief as prayed for ?

    DECISION  WITH   REASONS      :

     

    1. Both the points aretaken up together for consideration. On scrutiny of the papers it appears that on 28-10-2012 the complainant visited the original o.ps. to manufacture one gold new chain in lieu of old gold chain weighing 1 vory 6 anas and paid Rs. 7,000/- as preliminary charge. It further appears from the document that the complainant repeatedly visited the goldsmith shop of Samir Roy, since deceased. He only endorsed the nest dates for delivery. On his death subsequently the agreement did not materialize.
    1. On the basis of the receipt issued by SamirRoy it is palpably proved that the complainant delivered one gold chain weighing 1 vory 6 anas and paid Rs. 7,000/- cash for manufacturing a new gold chain within 15 days. As the same could not be delivered, the o.ps. has no alternative than to return the same amount of gold together with the advance money of Rs. 7,000/-. Both the points are accordingly disposed of.

      Hence,

O     R     D      E      R      E        D

      That the C. C. Case No. 445  of 2013 ( HDF 445 of 2013 )  be  allowed on contest with  costs  as against  the O.Ps. 

      The O.Ps. be directed to return the gold weighing 1 vory 6 anas together with advance money of  Rs. 7,000/- to the complainant within 30 days from the date of this order.

      The o.ps. be further directed to pay a  sum of Rs. 10,000/-  to the complainant as compensation for causing mental pain and prolonged harassment and Rs. 3,000/- as litigation costs.

      The complainant is at liberty to put the decree into execution after expiry of the appeal period.

      Supply the copies of the order to the parties, as per rule.
