It is hereby ordered that the present Appeal filed by the Appeallant herein is hereby allowed and accordingly the impugned Order dated 13.2.2013 passed by Learned Consumer Dispute Redressal Forum, South Goa at Margao in Complaint No. 4/2009 is hereby set aside. We remand the matter back to the Learned Lower Forum with direction to hear the Appeallant herein and for that matter also the Respondent herein, on merits of the caseand to dispose of the said complaint finally within three months from the date of the first appearance of the parties before the Lower Forum as per the direction that follows. The parties herein are hereby directed to appear before the Learned South Goa Forum on 14.2.2014. There shall be no Order s to costs.
