Both parties are present by filing hazira through their Ld. Agent.

The Complainant is present on call.

The Complainant has filed petition and stated that he is not willing to proceed with the case as he had already received the face value and the interest by cheque filed by the O.P.

On behalf of the O.P, the Ld. Agent has filed petition along with the cheques for the interest and has prayed for dismissing the case after having the cheques to the Complainant.

The Ld. Agent for the Complainant has submitted that the case has been compromised between the parties.

As and when the Complainant received the claim amount with interest from the O.Ps, the case should be disposed off accordingly.

Let the four cheques bearing No. (1) 072192 dated 21/05/2007, (2) 072193 dated 21/05/2007, (3) 072194 dated 21/05/2007 and (4) 072195 dated 21/05/2007 in the name of the Complainant amounting Rs.158.40/- each be handed over to the Complainant on proper receipt and identification.

The Complainant has received the said cheques filed by the O.P.

Hence,

                Ordered,

                                That the case be and the same is dismissed for non-prosecution on compromise and thus disposed off.
