        Complainant is present. Complainant files an affidavit stating that, although he had paid Rs.2440/- for the price of the saree, the bill was issued for Rs. 2438/- and the O.P. had not returned the  balance amount of Rs 2/- to the complainant.

         Perused the complainant petition and the Xerox copy of the cash memo , filed by the complainant . The cash memo was issued by the OP for Rs.2438/- In his complainant petition the complainant has mentioned the price for the saree as Rs. 2440/-. The cash memo does not  disclose the name of the purchaser nor there is any condition for guarantee  of warranty for the disputed saree.

             Accordingly the material available on record does not disclose a dispute under the provisions of C.P. Act. Hence the case is dismissed as not admitted. 

    Pronounced in the open Forum  to-day  i.e the  20^th  day of   June’  2018.
