The complainant was treated in OP No. 1 hospital from 04/08/2014 till 06/08/2012 and as far as the treatment is concerned the complainant seems to have no grievance at all either against OP No. 1 hospital or OP No. 2 Dr. Jhaverani. The entire case of the complainant is based on the alleged advice given by OP No. 2 Dr. Jhaverani to complinant's wife and son to admit him to IPHB because of the conduct of the complainant while in OP No. 1 hospital. The complainant would submit that the said advice, given by OP No. 2 Dr. Jhaverani amount to medical negligence. We are afraid we cannot accept such a submission. It is common knowledge that those who suffer from bouts of migraine do become irritable. It is quite probable that it was due to migraine that the complainant shouted at the staff of the ICU. However, mere advice to complainant's wife and son, to get the complainant admitted to another hospital, even if such hospital is OPHB, would not amount to medical negligence. The complainant might or might not have been admitted to IPHB. That he ran therefrom is another matter. That the complainant would have been detained in IPHB and given an injection is only a figment of complainant's imagination.

Complaint filed by the complainant was not rightly admitted by the Lr. District Forum. Appeal, therefore, is hereby dismissed.
