Behera, President: - The brief facts of the complainant’s case is that, the complainant has purchased one Dove hair fall rescue 180ml along with other articles from the O.P on dtd. 26.09.2017. The said product was having MRP of Rs.128/- on which Rs.15/- was off and it was costing Rs.113/- but the O.P has taken Rs.124/- i.e. Rs.11/- extra from the complainant, hence this case.

The O.P. appeared through his counsel after being noticed and submitted that there may be inadvertent mistake while updating the price of products in computer system and it was caused wrong billing.  The O.P refunds the extra amount to the customers immediately but the complainant without referring the issue filed this case and the case may be dismissed.

Heard and gone through the materials available. The complainant purchased a Dove hair fall rescue 180ml shampoo with other articles from the O.P on dtd. 26.09.2017 which was having MRP of Rs.128/- only and it was offered for Rs.113/- only but the O.P billed for Rs.124/- only i.e. Rs.11/- only more amount. The O.P admitted his fault as they have not updated the price of products in their computer system.  While raising the issue by the complainant it came to knowledge. Before raising of such issue the O.P could have sold the said product along with other products without updating the price and could have taken price of products haphazardly which is illegal.

On the above circumstances the O.P found to be adopting unfair trade practice on his part towards the complainant. Hence we are in considered opinion to allow the complaint petition with direction to the O.P to update the price of products in the computer system immediately and pay a sum of Rs.8,000/-(Rupees eight thousand) only to the complainant towards harassment, mental agony including litigation cost, failing which interest will be charges @ 12% per annum to the O.P till realization.

            Accordingly the case is disposed of.

Order pronounced in the open court today the 10th day of April’ 2018 and copy of this order shall be supplied to the parties as per rule.
