Final Order / Judgement

Hon’ble Mr. Ajeya Matilal, Presiding Member

          Today is fixed for showing cause by the appellant.

          Appellant is absent without any steps.

          The Ld. Advocate for the respondent nos. 8 and 9 is present.

          Being aggrieved by and dissatisfied with order dt. 15.09.2021 passed by Ld. DCDRC, Unit-III in CC/324/2021 observing that the complaint was not maintainable and dismissing the same, the appellant / complainant preferred this appeal.

          In the impugned order the Ld. Forum below observed whether the fraud was practised or not in the case concerned can only be determined by a Civil Court having jurisdiction to try the same.

          Perused the impugned order along with materials on record, we did not find any illegality in the impugned order.

          Accordingly, A/104/2021 is dismissed. The impugned order is upheld. There shall be nor order as to the costs.

          Let a copy of this order be sent to the Ld. Forum below.

          Joint Registrar of this Commission is directed to do the needful in this regard.
