1.                  The instant case was filed by complainant   U/S 12 of the  C.P.  Act,

1986, as amended against the O.Ps.  alleging deficiency in service U/S 2( 1 )( g ),  2( 1 )( o ) of the C.P. Act, 1986 wherein the complainant has prayed for direction upon the O.Ps. for execution and registration of the sale deed of the A Schedule property after receiving the balance amount and for compensation to the tune of Rs. 5 lacs together with other costs as the o.ps. in spite of the deed of agreement for sale dated 11-01-2012 and after receiving Rs. 1,01,000/- as advance out of the total consideration money of Rs. 14 lacs did not mutate the said property and convert the same from danga land to bastu land within 15 days from the date of this agreement.

 

2.                  Notices were  sent to the o.ps. but S/R received with the postal

endorsement 'left'. Inasmuch as the o.ps. did not leave their ongoing address to the existing address, endorsement 'left' is a good service in view of the decision of the Hon'ble Court. So the case was heard ex parte.  

             

 

DECISION  WITH   REASONS      :

 

3.                  Perused the deed of agreement wherein it transpires that the

complainant paid Rs. 1,01,000/- as earnest money out of the total consideration of Rs. 14 lacs. In view of the unchallenged testimonies and the decision reported in 2005(1)  CLJ (Cal ) we are of the view that the complainant is entitled to the relief as prayed for.

            Hence,

                                    O     R     D      E      R      E        D

 

           

      That the C. C. Case No. 126  of 2012 ( HDF 126 of 2012 )  be  allowed ex parte against    all the O.Ps. with costs.   

 

      The complainant  be directed to pay the balance consideration amount to Rs. 12,99,000/- to the o.ps. within 15 days from the date of this order to facilitate the execution and registration of the deed.

 

      The o.ps. be directed to cause execution and registration of the sale deed with respect to 'A' Schedule property within next 15 days after receiving the balance amount. 

 

      The complainant is entitled to a compensation of Rs. 1 lac for mental agony and prolonged harassment. He is further entitled to a litigation costs of. Rs. 5,000/- from the o.ps.

 

 

 

      The complainant is at liberty to put the decree into execution after expiry of the appeal period.

       

      Supply the copies of the order to the parties, as per rule.
