Both party are absent. Nobody appear on behalf of the parties or their counsels after several reputed calls. On perusal of the records it appears that complainant Chnadrmohan Birua filed this case the O.P Shai Prakash Properties development ltd for 40% dedcuction in deposite rupees for his wife who is pregnant. And case was filed on 05/11/2015 and next date of this case was 09/11/2015 and issue notice to the O.P on 28/01/2016 but both parties did not appear up till now. Further it appears after issuing notice to the O.Ps. O.P never had appear before the forum then after lapse of two years office is again for interest of justice issuing notice to the O.P and forum is directed in order dated 08/05/2017 specially to the complainant is that the complainant positively appear before the forum and also filed a requested for issuing notice to the O.P and case was fixed today but the complainant did not appear today. It means complainant has no interest in his case. Hence in default of the complainant this case is here by dismissed.
