Case called out. Heard Sri A.K. Srivastava, ld. counsel for the appellants and Sri ArunTandan, ld. counsel for the respondent.

This appeal has been filed against the judgment and order dated 13.10.2008 passed by the ld. District Forum-II, Bareilly in complaint case no.32 of 2007, whereby the ld. District Forum directed to return the deposited amount Rs.5,000.00 alongwith damages for interest Rs.2,500.00 and further directed to pay Rs.2,000.00 for cost of litigation. 

On perusal of the record, it appears that the complainant deposited Rs.5,000.00 on 15.4.2004 in Rajat Yojna of the appellant and receipt no.427842087 was issued in favour of the depositor but this amount was never returned to the depositor. Hence, the ld. District Consumer Forum directed to return the amount alongwith interest amount as mentioned above.

Ld. counsel for the appellant submitted that the ld. District Consumer Forum passed illegal judgment without proper appreciation of evidence but on perusal of the judgment it appears that the ld. District Forum appreciated the evidence and consider the receipt provided by the appellant itself.   

The impugned judgment and order requires no interference.

Hence, the appeal is dismissed.

If, any amount, is deposited by the appellant at the time of filing of this appeal under section 15 of the Consumer Protection Act, 1986, may be remitted to the ld. District Consumer Forum concerned for satisfying the decree, as per rules alongwith accrued interest upto date.
