Final Order / Judgement Learned Counsel for the Appellant is present.   On perusal of records, it is found that notices were issued to both the Parties on dt.09-05-2022, unserved notice was returned back from sole Respondent with postal remark “expired”.   On dt.21-11-2022, Appellant was directed to take steps to substitute the legal heirs of Respondent.   On dt.21-01-2023, Learned Counsel Mr. A.K.Samal undertakes to file V.Nama on behalf of the Respondent along with appropriate petition to substitute legal heir of Respondent.   To-day neither Learned Counsel for the Appellant take steps to substitute the legal heir of Respondent nor legal heirs of Respondent is present.   In view of such facts, the Appeal stands abated as against the deceased Respondent.
