Complaint under section-12 of Consumer Protection Act, 1986

Now  amended  Section 34 of Consumer protection Act 2019.

                             (Defence on behalf  of opposite parties Nos.1 to 3 struck off vide order dated 16.09.22)

ORDER:  

                             The facts in brief of the complaint are that  on the allurement of the representative of the opposite parties the complainant had invested the amount of Rs.59,000/- under the scheme of the Sahara Abode Bond and in this regard the complainant had obtained the Sahara bond the details of the Sahara bond vide receipt NO. 129709327574 dated 31.10.2009 for Rs.15,000/- and receipt No. 129709327575 dated 31.10.2009 for Rs.15,000/- and receipt No. 129709327576 for Rs.15,000/-  AND RECEIPT No. 129709327577 for Rs.14,000/- total amounting to Rs.59,000/- and the said bond would be matured in the year 2017. After its maturity amount, the complainant requested to the opposite parties to make the said amount alongwith interest but the representative of the opposite parties lingering the matter on one pretext to the another and later on the said amount had been converted in Saharayan Universal Multipurpose Society Limited on 30.12.2017 for a next three years i.e. 30.12.2020 vide receipt NO. 34040783184, 34040783185, 34040783186, 34040783187 vide member NO. 912977001378 amounting to Rs.46,500/- , 46,500/- and 43,600/- and Rs.8500/- total amounting to Rs.1,45,100/-.  After its maturity of the above said respective bon d the complainant  requested to the opposite parties to release the maturity amount alongwith interest but the representatives of the opposite parties linger on the matter on one pretext to the another and want to grab the hard earned money of the complainant by hook or crook. The aforesaid act of opposite parties amounts to deficiency of service and hence the complaint.  The complainant has prayed for directions to the opposite parties to:

a)                make the maturity amount pertaining to the respective bond alongwith interest @ 18% p.a. from maturity of the said policy/scheme to the complainant.

 b)                pay Rs. 1,00,000/- as compensation for causing mental agony and harassment .

c)                 pay Rs. 11,000 /-as litigation expenses.

2.                Upon receipt of the complaint notices were sent to opposite party. Opposite party put in appearance through counsel. Despite availing several opportunities written statement had been filed on behalf of opposite party. Therefore, defence of opposite parties was struck off vide order dated 16.09.2022.

3.                We have heard complainant in person  and also have gone through the case file.

4.                In this case the complaint was filed by the complainant against opposite parties – Sahara India Pariwar with the prayer to: a)  make the maturity amount pertaining to the respective bond alongwith interest @ 18% p.a. from maturity of the said policy/scheme to the complainant.  b)       pay Rs. 1,00,000/- as compensation for causing mental agony and harassment . c) pay Rs. 11,000 /-as litigation expenses.

                   To establish his case, the complainant has led  in her evidence Ex. CW1/A – affidavit of Smt.Maina Devi, Last Status Date,, Receipts,

5.                There is nothing on record to disbelieve and discredit the aforesaid evidence of complainant.  Since opposite parties had not filed written statement to contest claim of the complainant despite availing several opportunities, therefore, defence of opposite parties was struck off vide order16.09.2022. Hence the allegations made in complaint by the complainant go unrebutted. From the aforesaid evidence it is amply proved that opposite party has rendered deficient services to the complainant. Hence, the complaint is allowed.

6.                Opposite parties are directed to :

a)                pay   the maturity amount pertaining to the respective bonds alongwith interest @ 6% p.a. from the date of filing of complaint till its realization.

b)                pay Rs.2200/- as compensation for causing mental agony and harassment.

No litigation charges will be given to the complainant as the complainant has been perusing the complaint herself.  Compliance of this order  be made within 30 days from the date of receipt of copy of this order.  Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
