Present: Ms. Seema Bhardwaj, counsel for the complainant.

Today the case is fixed for consideration on the point of admissibility.

The complainant has filed the present complaint under Section 35 of the Consumer Protection Act, 2019 against the opposite parties (hereinafter referred to as (OPs) on the averments that he has invested an amount of Rs.117650/- by way of purchasing 3 FDRs bearing Nos.085000602430 dated 23.02.2016, 467003682625 dated 10.06.2020, 085000605065 dated 30.01.2016. And after the maturity, the complainant made request to pay the maturity amount but OPs have refused to pay the maturity amount without any cogent reasons.

Arguments on the point of admissibility heard.

The complainant has alleged that OPs had issued the three FDRs and on maturity of said FDRs, the complainant is entitled for the maturity amount. On perusal of the documents attached with the file, the said documents are not in shape of the FDRs, rather these are membership certificates. In the whole membership certificates, it is no where mentioned that the amount deposited by the complainant will be treated as FDRs and on the maturity, complainant is entitled for the maturity value. The complainant has invested the money in membership not in FDR. Hence, the present complaint is devoid of merits and same deserves to be dismissed and same is hereby dismissed. Parties concerned be communicated of the order accordingly and file be consigned to the record room.
