Both the parties are present through their learned counsels.

The learned counsel for the O.P. vide Petition No.54/09 dated 24/02/2009 submitted that the O.P. appointed Advocate Sri Hajrat Ali Ahmed as the arbitrator in this suit and the photocopy of the appointment letter of the arbitrator has also been attached to the petition and prayed disposing the case outside the court through the arbitrator. The learned counsel for the petitioner by filing Petition No.144/09 dated 03/06/2009 raised no objection in this matter.

Seen the petitions. Heard the learned counsel for both the parties.

Since the O.P. has appointed an arbitrator for settlement of this case outside the purview of this court, hence, further proceeding of the case is stayed till the same is disposed of by the arbitrator.
