Dev Shanker Sharma vs.  Sahara India etc.

                   Present:       Sh. Narendra Sharma, Advocate for complainant.                                     

                                 Opposite party no.1 already given up.                                                         

                                   Opposite party no.2 already exparte.                                                           

                                      Although today the case is fixed for remaining arguments but the perusal of the file reveals that it is inadvertently mentioned in the order dated 24.08.2023 that ld. counsel for complainant filed affidavit and copies of documents and closed evidence because so far ld. counsel for complainant has not tendered affidavit or any documents. The said mistake is rectified accordingly.

                                       The complainant has filed the present complaint against opposite parties seeking refund of his deposited amount/ maturity amount. However, in view of the order dated 29.03.2023 passed by the Hon’ble Supreme Court of India in I.A. No. 56308 of 2023 in Writ Petition (C) No. 191 of 2022 titled as Pinak Pani Mhanty Versus Union of India and others, now the present complaint filed by complainant before this Commission is not maintainable. As such, the present complaint is hereby dismissed. However, complainant is at liberty to apply for refund of amount before Central Registrar of Cooperative Societies as per the order of the Hon’ble Supreme Court. File be consigned to the record room.
