ORDER

1.        Sh.Ammish Goel, Advocate, puts in appearance on behalf of JDs/OPs and filed memo of appearance.

2.        Heard. Order dated 20.12.2018 perused. Per this order, it was observed that complainant/decree holder is not in possession of fresh list of property owned and possessed by JDs so as to proceed with the execution of the order of this Forum by way of issuance of certificate of recovery to the District Collector in view of Section 25 of the Consumer Protection Act, 1986. It is stated that decree holder is not aware of the property owned and possessed by JDs from which the amount in execution could be recovered as arrears of land revenue. Earlier this execution was adjourned sine die. It is also stated that Hon’ble Apex Court has already seized of the matter in which direction was passed against the JDs not to sell movable or immovable property. Since the identification of the property owned and possessed by JDs is not known to the decree holder, therefore, we proceed to dispose of this execution as unsatisfied. However, as and when decree holder comes to know regarding the identification of the property or any other order received from Hon’ble Apex Court, formal application be moved in which present execution would also be tagged.
