  1. This is an application U/S 12 of the C. P. Act, 1986 filed by the complainant, Kakuli Sandhukhan,  against the o.p., Sahara India Financial Co. Ltd., praying for   direction upon the o.p. to release the fixed deposit amount being Rs.12,160/- and damages being Rs. 10,000/-  and Rs. 5,000/- as cost of proceeding.
  1. The case of the petitioner is that he invested Rs. 5,000/- in the Sahara Unique Scheme on 01.01.2008 being account no. 15852300228 for 96 months. The fixed deposit got matured in the year 2016 but the o.p. did not release the maturity value in favour of the petitioner and thus being compelled the petitioner  to file this case.   
  1. The o.p. though served with notice yet did not appear personally for contesting the case which is heard ex parte againstthe o.p.

4. The only point to be decided here is whether the complainant is entitled tothe reliefs as prayed for ?

DECISION  WITH   REASONS      :

  1. In support of her case the petitioner filed affidavit as well as documents being the fixed deposit certificate issued by the o.p. and her oral evidence and the documents proved the case that the petitioner though deposited Rs. 5,000/- in Sahara Unique Scheme of the o.p. for eight years yet after the maturity she was not provided with the amount and the same compelled her to file this case. All the above oral and documentary evidences went unchallenged and there is nothing to disbelieve the case of the petitioner.

In the result, the application succeeds. 

            Court fee paid is correct.

      Hence,

                                        O     R     D      E      R      E        D           

      That the C. C. Case No. 371  of 2016 ( HDF 371 of 2016 )  be  and the same is allowed  ex parte with costs against the o.p.

      The petitioner is entitled to the relief as prayed. The o.p. is directed to pay the matured amount of the fixed deposit amounting to Rs. 12,160/- within one month from the date of this order along with Rs. 5,000/- out of which Rs. 2,000/- would go to the petitioner as litigation costs and the rest of  Rs. 3,000/- would be deposited in the Consumer Legal Aid Account of this District Forum and O.P. to pay another Rs.2,000/- to the petitioner as compensation.

      If the o.p. does  not pay the above mentioned amount within the stipulated period, the complainant is at liberty to put the final order into execution after expiry of the appeal period.         

     Supply the copies of the order to the petitioner, free of costs.
