ORDER

PER K.K. KAREER, PRESIDENT

1.                Briefly stated, the case of the complainant is that in the month of May 2018, an agent of the OPs approached the complainant and allured him to invest his savings with the OPs saying that the OPs would provide good returns in terms of interest. As a result, the complainant deposited a sum of Rs.1,21,970/-. The OPs issued a certificate No.78700489568. The date of maturity was 26.10.2019 and the maturity amount of Rs.1,42,710/-. However, the OPs failed to encash the certificate when they were approached by the complainant after the date of maturity. This amounts to deficiency of service on the part of the OPs. In the end, it has been requested that the OPs be directed to pay a sum of Rs.1,21,970/- with interest @11% per annum and compensation of Rs.5,00,000/-.

2.                Upon notice, OPs did not appear despite service and were proceeded against exparte.

3.                In exparte evidence, the complainant submitted his affidavit as Ex. CA along with documents Ex. C1 and Ex. C2 and closed the evidence.

4.                We have heard the counsel for the complainant and have also gone through the record.

5.                From  the uncontroverted exparte evidence led by the evidence on record, it has been established that the complainant invested amount of Rs.1,21,870/- with the OPs in the month of May 2018. The said amount has not been repaid by the complainant by the OPs. This amounts to deficiency of service on the part of the OPs.  In our considered view, it would be just and proper if the OPs are directed to pay the maturity amount of Rs.1,42,710/- along with interest @8% from 26.10.2019 till date of actual payment along with composite costs of Rs.5,000/-.

6.                As a result of above discussion, the complaint is allowed exparte with an order that the OPs shall be jointly and severally liable to pay the maturity amount of Rs.1,42,710/- to the complainant along with interest @8% per annum  from 26.10.2019 till date of actual payment. The OPs shall further pay a composite compensation of Rs.5,000/- (Rupees Five Thousand only) to the complainant. Compliance of order be made within 30 days from the date of receipt of copy of the order. Copies of order be supplied to parties free of costs as per rules. File be indexed and consigned to record room.
