The Complainant has filed the present complaint under Section 35 of the Consumer Protection Act, 2019.

Case of the Complainant

  1. The case of the Complainant as revealed from the record is that the Complainant had made a fixed deposit with Opposite Party (Sahara U) in 2019 vide account no. 71297800408, having membership no. 71291500288. Complainant stated that she had deposited Rs. 12,000/- vide certificate/bond no. 755000242636, receipt no. 80824633082 dated 06.05.2019 with Opposite Party (Sahara U). Complainant stated that she deposited the said bond as fixed despite with Opposite Party (Sahara U) for a period of 48 months and the maturity amount was Rs. 18,000/- and the date of maturity was 06.11.2022. Complainant stated that she had also made a fixed depot with Opposite Party (Sahara V. Double) in 2015 vide account no. 71295600699, having membership no. 7129150028. Complainant stated that she had deposited Rs. 5,000/- vide certificate/bond no. 765000237151, receipt no. 80538856555 dated 01.12.2015. Complainant sated that she had deposited the said bond as fixed bond with Opposite Party (Sahara V. Double) for a period of 48 months and the maturity amount was Rs. 10,550/- and the date of the maturity was 01.12.2021. Complainant stated that she continuously visited the office of Opposite Party for her compensation amount but Opposite Party had been delaying for the payment of the said policy amount. Hence, this shows the deficiency of service on the part of Opposite Party.  Complainant has prayed for the whole amount of policies i.e 28,550/- along with interest. Complainant also prayed for an amount of RS. 10,000/- on account of mental harassment and Rs. 5,000/- on account of litigation expenses.
  2. None has appeared on behalf of the Opposite Party despite service of notice to contest the case. Therefore, Opposite Party was proceeded against ex-parte vide order dated 03.03.2023.

  1. The Complainant in support of her case filed her affidavit wherein she has supported the assertions made in the complaint.

Arguments & Conclusion

  1. We have heard the AR for the Complainant. We have also perused the file and written arguments filed by the Complainant. The averments made by the Complainant in the complaint are supported by her affidavit and documents filed by her. The Opposite Party did not appear and did not file any written statement. Therefore, the averments made in the complaint are to be believed.
  2. In view of the above, the complaint is allowed. Opposite Party is directed to pay an amount of Rs. 28,550/- along with interest @ 9 % p.a. from the date of filing the complaint till recovery on completing the formalities with regard to payment of maturity amount with Opposite Party. Opposite Party is also directed to pay an amount of Ra. 10,000/-on account of mental harassment and litigation expenses to the Complainant along with interest @9 % p.a. from the date of this order till recovery.
  3. Order announced on 02.04.2024.
