DISTRICT CONSUMER DISPUTES REDRESSAL COMMISSION: NORTH-EAST
The Complainant has filed the present complaint under Section 35 of the Consumer Protection Act, 2019.
Case of the Complainant
The case of the Complainant as revealed from the record is that the Complainant opened an account bearing no. 24741700066 under Sahara A. Select Scheme and deposited a sum of Rs. 2,00,000/- for a period of 18 months. The said account was opened on 31.01.2017 and the maturity value for the same was Rs. 2,32,600/- as on 31.07.2018. It is her case that after maturity, Complainant went to Opposite Party and request for payment of maturity amount then Opposite Party requested the Complainant to wait for some time as the Opposite Party did not have sufficient fund. It is her case that after one year Opposite Party were made the total payment of Rs. 1,28,000/- on various dates. It is her case that an amount of Rs. 1,04,600/- is still pending and Opposite Party did not make any payment further. Hence, there is deficiency of service on the part of Opposite Party. Complainant has prayed to direct the Opposite Party to pay the principal amount i.e. Rs. 1,04,600/- along with 15 % interest on reducing amount basis. Complainant also prayed for an amount of Rs. 50,000/- on account of mental harassment and Rs. 25,000/- on account of litigation expenses. Complainant also prayed to direct the Opposite Party to pay pende-lite and future interest @ 15 % p.a. till realization.
None has appeared on behalf of the Opposite Party to contest the case despite service of notice. Therefore, Opposite Party was proceeded against ex-parte vide order dated 07.12.2022.

The Complainant in support of her case filed her affidavit wherein she has supported the assertions made in the complaint.
Arguments & Conclusion
We have heard the Ld. Counsel for the Complainant. We have also perused the file and written arguments filed by the Complainant.The averments made by the Complainant in the complaint are supported by her affidavit and documents filed by her. The Opposite Party did not appear and did not file any written statement. Therefore, the averments made in the complaint are to be believed.
In view of the above discussion, the complaint is allowed. Opposite Party is directed to pay an amount of Rs. 1,04,600/- to the Complainant along with interest @ 6 % p.a. from the date of filing the complaint till recovery. Opposite Party is also directed to pay an amount of Rs. 15,000/- on account of mental harassment and Rs. 10,000/- on account of litigation expenses to the Complainant along with interest @ 6 % p.a. from the date of this order till recovery.
