             Keeping in view the even dated separate statement suffered by the counsel for the complainant, the present complaint is dismissed as withdrawn with no order as to costs.  However, complainant shall be at liberty to file a fresh complaint after removing the legal defect and will disclose the particular of present complaint and its fate in the fresh complaint.
