ORDER
Learned Advocae Mr. A.Sengupta is present for the complainant and by a petition he prays for time on the ground stated therein. A written argument was already submitted from the side of the O.P. challenging the maintainability of the proceeding. Mr. Sengupta submits that a Revision Petition is pending before the National Commission against the O.P. in respect of same issue. So, he prays for an adjournment.
We can not adjourn the case on this ground.
It is pertinent to mention here that earlier this Commission delivered a judgment in connection with C.C.-72/2019(Smt. Paramita Deb Vrs. The Sector Head, Agartala City Office Sahara Credit Co-operative Society Ltd.) on 30.12.2020 and that case was dismissed being not maintainable as per law. Thereafter, the complainant Smt. Paramita Deb preferred an appeal before the Hon'ble State Commission and the appeal was numbered as case No.A/02/2021. The Hon'ble State Commission upheld the order passed by this Commission vide order dated 10.05.2021. So, the instant case is a covered case. It is not necessary to discuss in details about the facts of the case as opposite party is the same.
Relying upon the judgment passed by the Hon'ble State Commission (Supra), we are in the opinion that the instant complaint is also not maintainable in law.
Hence, the complaint is dismissed and no cost.
Supply copy of the order to both side free of costs.
