No step from the side of the complainant.

Today is fixed for hearing on admission.

On perusal of the complaint petition we find that complainant Smt. Mallika Sarkar filed the complaint U/S 35 of the Consumer Protection Act, 2019 against the Sahara Credit Co-operative Society Ltd. and others claiming a direction to make payment of certificate amount along with compensation and interest. 

It is pertinent to mention here that earlier one Smt. Paramita Deb filed similar case against Sahara Credit Co-operative Society Ltd. and it was being numbered as CC-72 of 2019, whereby and whereunder this Commission dismissed the complaint petition vide its judgment dated 30.12.2020 and subsequently complainant preferred an Appeal before the Hon'ble State Consumer Disputes Redressal Commission, the appeal also being numbered as A-02 of 2021 and Hon'ble State Commission vide judgment dated 10.05.2021 upheld the judgment and order passed in CC-72 of 2019 and held that the complaint is not maintainable in law.

Since the present complaint is filed against the Sahara Credit Co-operative Society Ltd. and in view of the judgment passed by the Hon'ble  State Commission as well as this Commission, we are in the opinion that the complaint is not maintainable in law. Hence, the complaint is rejected. 

Supply a copy of this order free of costs to the complainant.
