Present:         Sh.Amandeep Bindra, Advocate for Complainant.

                        Sh.Navjinder S.Sidhu, Advocate for OPs.

Dated, the 22nd day of January, 2010.

                                                            ORDER

                       

1.                     Counsel for OP has brought a cheque of Rs.32,774/- in the name of complainant, which the counsel for complainant has received and made statement for withdrawal of the execution application, which is reproduced as under:

“Statement of Sh.Amandeep Bindra,Advocate for Complainant.

 

I have received cheque No.560221, dated 21.1.2010 for a sum of Rs.32,774/- drawn on Bank of Baroda, Sector 22-B, Chandigarh in the name of complainant M.P.S.Bindra, which includes Rs.5000/- as costs of execution proceedings. The complainant has already received Rs.88,122/- through cheque on 18.12.2009. Since the decretal amount has been received and the order dated 17.9.2009 has been complied with by the OP, hence I withdraw the present execution application.”

 

2.                     In view of the statement made by counsel for complainant, the execution application is dismissed as withdrawn.

3.                     The certificate issued to the Collector concerned under Section 25(3) of the C.P.Act is hereby cancelled and be called back.

4.                     Copies of this order free of cost be supplied to the parties. The file be consigned.
