No. 1/10.08.2009.

SRI A. K. RAY, MEMBER.

Heard Mr. Jayanta Ranjan Das, the Ld. Advocate for the Appellants.  It appears that the final order was passed by the Forum below on 30.08.2009 and thereafter the party in question slept for about two years to come up with a put up petition before the Forum below for modification of its final order.  The Forum below rightly rejected the same.  Thereafter this appeal petition has been filed before us.  We apprehend that the Appellants have not come to us with a clean hand.  The put up petition was filed before the Forum only to avoid the passage of time.  In the circumstances being satisfied that the Appellants did not come to us with a clean hand and they had also approached the Forum below with the said put up petition only to bridge up the inordinate and huge gap of time, we are not inclined to accept the instant memo of appeal.  The same is, therefore, summarily rejected.
