Appeal No.313/09 is filed by Gimco Ltd. i.e. the original opponent  and A.No.292/09 is filed by Sakharkar builers i.e. original complainant are against the same judgment and award passed by the Additional District Forum, Nagpur.   Both these appeals are taken on record on the joint application filed by both the parties.  Both the parties have settled the original dispute out of court and thereby Gimco Pvt.Ltd. and Hindustan Motors agreed to pay Rs.2,75,000/- to Sakharkar Builders involved in these two appeals. In view of the settlement, the Gimco Ltd. wants to withdraw appeal No.313/09 and Sakharkar builers wants to withdraw A.No.292/09 and they are withdrawing these appeals on the condition of satisfaction of full and final amount. We make it clear that record of A No.292/09 is presently not available but still both these appeals are being disposed of by common order. Hence the following order…                                                        ORDER

1)      Appeal No.313/09 Gimco Ltd. Vs. Sakharkar builers and A.No.292/09 Sakharkar builers Vs. Gimco Ltd. are dismissed as withdrawn in view of the Memo of Understanding and final settlement arrived at between the parties.

2)      Registrar is directed to trace out missing A.No.292/09 and copy of this order be placed in that file after it is traced out.
