                   Mrs. Amarlata, learned counsel for the appellant has appeared and suffered a statement that appeal which was filed in the name as the then Managing Director of the Hospital namely Dr. Shayam Sunder Bansal. Now, he is neither a shareholder nor the Director of M/s Metro Heart Institute with Multispecialty and Hospital and left the hospital w.e.f. 10.11.2020 (Anenxure-1 i.e. Retirement Deed). Therefore, Dr. Shayam Sunder Bansal (appellant) had already moved an application for withdrawal of his name from the present appeal. Hence, on the instructions of the appellant, she may be permitted to withdraw the present appeal. Her statement in this regard recorded separately.

2.                In pursuance of the statement suffered by Mrs. Amarlata, learned counsel for the appellant, the present appeal stands dismissed as withdrawn.

3.                A copy of this order be provided to all the parties free of cost as mandated by the Consumer Protection Act, 2019. This order be also uploaded forthwith on the website of the Commission for the perusal of the parties.

4.                Application(s), pending, if any, stand disposed off accordingly in terms of this order.

5.                Statutory amount of Rs.25,000/- (Rs. Twenty Five thousand only) deposited at the time of filing of present appeal be refunded to the appellant against proper receipt, identification and as per rules.

6.                File be consigned to record room alongwith a copy of this order.
