An application for compromise has been moved in both the appeals Nos. 191 of 2012; Ram Institute of Hotel Management and Catering Technology vs. Sachin Singh Rawat and another and 206 of 2014; Kul Sachiv, HNB Garhwal University vs. Sachin Singh Rawat and another.  In this application the respondent No. 1 Sachin Singh Rawat has entered into the compromise with the appellant and in this compromise it was stated that respondent No. 1 has received the marksheets of B.H.M.C.T., Ist and IVth Semester before this Commission and further requested that the amount of compensation awarded by the District Forum (on the ground of mental agony and litigation expenses) does not want to realise from the appellant.  In view of the fact that he has received the marksheets and in allowing the appeal, he has no objections.  The said application for compromise has been signed by Sh. S.S. Negi, Advocate, brief holder of Sh. Anurag Gupta, Advocate, on behalf of the appellant and Sh. Pradeep Bartwal, Advocate on behalf of the respondent No. 2.  Respondent No. 1-Sachin Singh Rawat has been identified by Sh. Pradeep Bartwal, Advocate.

In view of the compromise, the appeal is partly allowed.  So far as the compensation is concerned, the finding given by the District Forum regarding compensation (on account of mental agony and litigation expenses) is set aside.  Respondent No. 1-Sachin Singh Rawat has already received marksheets. 

The grievance to the respondent No. 1 is redressed.

Both the appeals are partly allowed in terms of compromise. 

The compromise is accepted. Case is decided in terms of Compromise.  This compromise shall be the part of the order.

Let the copy of this order be placed in the file of appeal No. 206 of 2014.
