ORDER

 

JUSTICE SRI.K.R.UDAYABHANU                   :PRESIDENT

 

            Revision petitioners are the opposite parties in CC.259/09 in the file of CDRF, Ernakulam.  The order is with respect to maintainability in the light of the decision of the Supreme Court in Martin F D’Souza vs Mohammed Ishtaq (2009) 3 SCC 1.   In Kishan Rao vs Nikhil Super Speciality Hospital (2010) 1 SCC 513 the Supreme Court has virtually ride tracked the decision in Martin F D’Souza case.  Hence the complainant is entitled to have  the matter tried on merits.  The Forum will dispose otf the matter on merits after permitting the  respective sides to adduce evidence etc.  without being influenced by the observations contained in the impugned order.

          The  case stands posted before the Forum on 23.11.2010.

          Office will forward the LCR along with the copy of this order to the Forum urgently.
