ORDER

Present:       Sh. Shashikant, Advocate for complainant alongwith                                   complainant.

                   Sh. Deepanshu Tuteja, Advocate for OP no.2.

                   OP no.1&3 exparte.

 

ORDER:

                        Today the case was fixed for arguments. Learned counsel for OP No.2 has made a statement that the matter has been compromised between the complainant and OP no.2. According to the compromise, the OP no.2 is ready to pay  the amount of Rs.35,600/- (Thirty  Five Thousand Six Hundred only) within a period of 30 days.  The complainant is directed to return the disputed mobile phone in the service centre with all accessories.

                        Complainant has made a statement that he has read and heard the above-mentioned statement given by learned counsel for the OP no.2.  Further complainant  stated that he has already submitted the disputed mobile phone   alongwith accessories in the service centre. According to that, the matter has been full & final settled in Rs.35,600/-.   .                           

                        Heard. Statement of both the parties recorded separately.

                        Keeping in view the statement made by complainant, this complaint is hereby dismissed as withdrawn. However, both the parties are bound by their statement. The OP no. 2 is directed to make compliance of their statement within 30 days as per their statement.

            File be consigned after due compliance.
