This complaint has been filed under section 12 of Consumer Protection Act, 1986 for the relief of direction, (1)directing the opposite party to pay a sum of Rs.17,37,500/-, the balance amount after deducting the construction work done by the opposite party, with interest at the rate of 12% per annum from the date of complaint till realization, (2)directing the opposite party to handover the building as on such condition to the complainant, (3) directing the opposite to pay a sum of Rs.2,00,000/- as compensation to the complainant, (4)directing the opposite party to pay a sum of Rs.50,000/- towards litigation costs.
2. Notice was issued to the opposite party and the opposite party appeared through his counsel.
3. Today when the case is came up for hearing, there was no representation from either side. Documents perused. Inspite of repeated adjournments none appeared on behalf of the complainant. The complaint is pending from 2018 onwards. Therefore, in view of the fact that the complainant is absent, the complaint is dismissed for default.
In the result, the complaint is dismissed for default. No costs.
