ORDER

The parties file Hazirah. 

The OP files questionnaires.

            The petition dt. 21.12. 2018 filed  of the complainant U/S 13(3B)  Cp Act for passing interim order is taken up for hearing treating the same as MA 151/2018 . 

The OP WBSEDCL has contested the Application without filing any formal objection.

            We find that it is the case of the complainant that she is Consumer but ID.No.522082913 under O.Ps and during  pendency of the case O.P sent a demand notice dated 05/11/2018 claiming Rs 50, 021/- and requested the complainant to pay the outstanding amount on 20/11/2018.  That the opposite party further informed that the service line was deemed disconnected.

            It is the further case or the complainant i.e. the as per notice dated 05/11/2018 sent by the OP the total outstanding dues of Rs. 50,021/- was lying due in the name of the complainant and the complainant deposited the said amount and as such she is entitled to get restoration of the electric line immediately but the opposite party did not do the same till date.

            That thereafter the complainant had been to the office of the opposite’s party several times and requested them to restore electric connection.  That the O.P disconnected the service connection of the complainant without serving notice U/S 56 of the Electricity Act, 2003.  That the service connection of the complainant is necessary to restore otherwise he will suffer irreparable loss and injury which cannot be compensated in any way and the O.Ps liable to restore the line.

We find form the notice dated 05.11.2018 and receipt dt.06.12.2018 that the complaint has already paid said dues i.e. Rs. 50,021/-.

During hearing Ld. Advocate/Agent submitted that in spite of payment of dues the op has already disconnected said line, which is required to be restore immediately to protect her standing crops.

Considering over all matter into consideration and material on record we think prayer for restoration Electric line is to be allowed.

                                                                                                                                    

Hence

Ordered,

   that the petition dated 21.12.18 filed by the complaint under Section 13 (3B)

Cp act for passing interim order i.e. MA 151/2018 is allowed on contest but without any cost.

The O.P 1 WBSEDCL, Murarai is directed to restore the electric line of the complainant Alimun Bibi being  ID.No.522082913 at once.

            Thus the MA is disposed of.

            Fixed 14.02.2019 for reply of questionnaires. 

The Copy of the order be supplied to the parties at free of cost.

The Copy of the order be sent to O.P No.1 W.B.S.E.D.L, Murarai through speed post for Compliance.
