ORDER

1.        Heard. A perusal of the statement dated 25.07.2022 made by the Proprietor of the OP namely Sh.Abhishek Singh shows that the OP has settled the matter with the complainants and undertook to pay Rs.27,500/- to the complainants as full and final settlement of the claim within 15 days from 25.07.2022. The case was then adjourned to 10.08.2022 for compliance of the undertaking, but on that date neither OP appeared nor compliance of the undertaking was made. In the interest of justice, the case was again adjourned for today i.e. 17.08.2022 for the same purpose.

2.        Today the counsel for the complainants has stated that the OP has failed to comply with its own undertaking as he has only paid a sum of Rs.10,000/- in the account of the complainant No.1 through google pay on 16.08.2022. He has further stated that the complaint be disposed off in view of the said undertaking and the penal cost be imposed upon the OP for not complying with its own undertaking and for causing mental agony and harassment to the complainants.

3.        Today we waited sufficiently, but neither OP nor anybody else on his behalf has turned up to pay the balance amount to the complainants as per undertaking given.

4.        In this view of the matter, we dispose of the complaint with a direction to the OP to pay the balance amount Rs.17,500/- (i.e. Rs.27,500/- minus Rs.10,000/-) to the complainants within a period of 30 days from today i.e. 17.08.2022, failing which besides the aforesaid amount, the OP shall pay an amount of Rs.15,000/- to the complainants as penal cost for defying from his own undertaking.

5.        Certified copies of this order be sent to the parties free of cost. The file be consigned.
