J U D G M E N T.

SRI  BIBEKANANDA DAS, MEMBER (I/c) :-

            The C.C. Case No.44/2022 is taken up today for order. The complainant being aggrieved by the deficiency in service  as well as  unfair trade practice  of the O.Ps. due to defective meter installed by the O.Ps. in his farm house for the purpose of irrigation pumping and agriculture, has filed  the present c.c. case for redressed of his grievance.

            Heard the learned counsels  from both the parties, perused the documents available on record and so also perused the written version filed by the O.Ps. Even after repeated  approaches made  by the complainant but the O.Ps. have not installed a new meter and charging  huge amount towards  consumption of electricity  and  there by the O.Ps. have committed deficiency in service  . The O.Ps.  are the service provider and the complainant has suffered a lot due to non-installation of a new meter by the O.Ps and for which the complainant is being charged for higher amount of energy charges for no fault of him.

            We have gone through the case record and documents available on record and we are of the opinion that the O.Ps. have committed deficiency in service  by not installing a new meter in place of the defective one in the farm house of complainant and they are solely responsible for the same. But however the O.Ps. have  filed one memo before this Commission on dt.03.03.2023 stating therein that they are ready and willing to install a new meter in the premises of complainant for agriculture purpose and revise the previous bills  as  per  actual consumption of electricity,

            From the above observation, it is clearly go to establish that the O.Ps. have committed deficiency in service  and for which the complainant has suffered a lot. So the O.Ps. are required to remove the defective meter from the farm house of the complainant by installing a new meter and also pay compensation of Rs. 10,000/- to the complainant due to the loss sustained by him during these period which is  ju.st and proper .

O R D E R.

It is directed that the O.Ps. shall install  a new meter in the farm house of the complainant and shall also  pay  Rs. 10,000/- to the complainant towards compensation and  revise the previous bills as per actual consumption of electricity  within a period of one month from the date of receipt of this order, failing which the O.Ps. shall be liable for execution proceeding as per C.P. Act., 2019. The c.c. case No. 44/2022 is allowed and accordingly disposed off.

            Issue extract of the order to the parties for complaisance.

            Pronounced in the open Commission on this the 31st day of March, 2023.
