Final Order / Judgement

ORDER BY HON’BLE MEMBER- MRS. M. SWAIN:

                                                                                      JUDGMENT

    Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking following reliefs;

    “Direct the opposite parties to supply of the extract copy of bill statement up to connection to till date and to reduce the excess bill and revise the bill as correct and wave out Rs.4,000/- of fine imposed by opposite parties”.

    The complainant is a domestic consumer having consumer No.04246892 under Electrical Circle, Kujanga since long and pays the electric dues regularly. The opposite parties have supplied electric bill on average basis up to 20.12.2019. So the complainant compelled to give high amount of electric bill as the bill supplied by opposite parties was on average basis. So arrear bill amount of Rs.1,08,339/- was pending with complainant as per electric bill of 12.12.2019. On 20.12.2019 opposite parties threatened the complainant to disconnect the electric connection of premises of complainant. At the time of average period of electric bill the complainant paid high amount of electric bill hence this complaint.

    Complainant submitted following documents in support of the case;

  1. Electric bill for the month of 16.10.2017.
  2. Electric bill for the month of 12.12.2019.

Notice was issued to opposite parties on 21.01.2020 by Regd. Post with AD. In spite of issue of notice the opposite parties never responded and was set ex-parte as the notice was sent in the correct address with postage prepaid for which notice was deemed to have been sufficient on the opposite parties. As the opposite parties preferred not to appear they were set ex-parte and this Commission proceeded to dispose the case.

It is crystal clear from the electric bill of the opposite parties that the bill was on average basis not on actual basis for which the complainant has to pay more electric bill than his actual consumption. Hence this is negligence on the part of opposite parties which create deficiency of service on the part of opposite parties.

Hence complaint petition is allowed. The opposite parties are directed to install a new meter in the premises of the complainant and on the basis of average of the bill as per actual consumption on six consecutive months of the bill, the electrical bill of the average period shall be taken into consideration and bill be rectified and fresh bill be issued and the order is carried out within 30 days from the receipt of the order. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
