Final Order / Judgement

                                                                                             JUDGMENT

 

            Complainant has filed this consumer complaint U/s.12 of C.P. Act, 1986 seeking the following reliefs:

            “Direct the opposite parties to supply of the extract copy of bill statement up to connection to till date and to reduce the excesses bill and revise the bill as correct and supply correct bill as per meter reading and waive out excess bill amount imposed by the opposite parties and not to disconnect the power supply to the premises of the complainant”.

            The brief facts of the case of the complainant is that, the complainant was domestic consumer under the opposite parties vide consumer No.04242637 and at the time of electric connection father of complainant submitted application with his detail address and all required documents but after two months of electric line connection the opposite parties supply their electric bill with wrong address hence the father of the complainant claimed before the opposite parties for correction of address of consumer but the opposite parties without taking any attempt for correction of bill imposed high amount of bill over the complainant and disconnected the line from the house of complainant but they continuously supply the electric bills. In the year 2005 the father of the complainant died hence the complainant rushed to the office of the opposite parties and requested for connection of line to his house. On 25.7.2016 the opposite parties reconnected the line to the house of the complainant and from that date the complainant continuously paid his electric bill as per meter reading and no pending arrear amount over the complainant. The opposite parties without reducing the excesses bill and without considering the grievance of the complainant by practicing unfair trade practice imposed the arrear dues on the complainant for which the complainant suffered great mental agony.   The complainant in his representation on dt.05.02.2020 has ventilated his grievance to the authorities regarding disconnection of line from 2005 to 2016.

            Notice was issued to opposite parties by Regd. Post on 11.03.2020 but the opposite parties did not turn up. As such we have no other option than to go through records and pass the order.

            The complainant has submitted that he is utilizing the electricity since 25.7.2016 and paying the bills regularly and the arrear amount has been added without any basis. The opposite parties have remained silent and not given any explanation for which to allow the consumer complaint by directing the opposite parties not to claim any arrear and disconnect the electric line. Since as per the provision of Electricity Rules, 100(2) no arrear beyond 2 years can be demand from the consumer and in this case the spending dues are of long back which is also disputed and objected by the late father of complainant. The complainant shall pay regular bills and arrear is pending from 25.7.2016 onwards. Accordingly the consumer complaint is disposed of without any cost.
