This C.C.Case No. 8/2020 taken up today for order. Heard both the parties& perused the relevant documents as available on record.
Brief facts:-
Complainant applied for Land line Bharat Sanchar Nigam Ltd.(BSNL) connection and deposited sum of Rs. 1000/- before Opp.Party towards security deposit and took Land line connection. As per allegation of the Complainant the 1st consumption bill imposed upon him was Rs.761/- which was excess and for which he requested the Opp,Party to disconnect the landline connection and waive out the highly inflated bill.
The Ld. S.D.O., BSNL, Kendrapara on behalf of Opp.Party appeared before this Commission & filed written version & submitted that, one time installation charge of Rs. 500/- is generally charged to every new customer in their 1st bill as per the norms. The subsequent bill of the Complainant generated was for May-2019 was Rs. 164/-, for June-2019 was Rs. 164/- & for July-2019 was 105/- which were minimum monthly fixed rentals. As per request of the Complainant, the Op waived out Rs. 245/- as rebate and after all the adjustments his total outstanding bill stands of Rs. 362/- till date.
Further it is submitted by the S.D.O.,BSNL, Kendrapara that, the Landline of the Complainant has already been disconnected since dtd. 20.07.2019 due to non-payment of the bill amount and the bills has been stopped since then and also submitted that, the Complainant has to give an application to the concerned authority for permanent disconnection of his landline and so also clear all his outstanding dues either by paying or else it can be adjusted from his security deposit upon taking his consent.
Taking into all the facts & circumstances stated above we are of the opinion that, the security deposit of the Complainant to be adjusted towards his outstanding dues of landline telephone on deposition of telephone receiver before the concerned authority.
O R D E R
It is directed that, the Complainant shall submit the Landline receiver alongwith an application before the Opp.Party for disconnection and further the Opp.Party is directed to adjust the outstanding dues of the Complainant in his security deposit amount within a period of two weeks from the date of receipt of this order and the Opp.Party shall not charge any further amount upon the Complainant. The complaint case is accordingly disposed off.
