ORDER

CC No.320 of 2019.

Sunil Kumar     Vs.    UHBVNL.

 

Present:      Sh. Ramnik Garg, Adv. for the complainant.

                   Sh. Balinder Singh, Adv. for the opponents. 

                    

                   File taken up on today, as the settlement dated 21.09.2023 received from the Coordinator, Mediation Cell of this Commission. The matter has been amicably settled between the parties before the Mediation Cell. Settlement received from the Coordinator, Mediation Cell and in order to identify this settlement, Ex.P1 is marked on it and Keeping in view the settlement Ex.P1, the complaint is, partly, accepted against the opponents with following terms and conditions:-

  1.         The opponents will adjust the disputed amount and afresh bill to be issued in favour of the complainant for the current reading          only.
  2.         The complainant will deposit the current bill within 10 days after the receipt of fresh bill from the opponents.
  3.         No dues certificate will be issued by the opponents after deposit of fresh bill, if NOC demanded by the complainant.

 

                  Due to amicable settlement of the matter between the parties, parties are left to bear their own cost of litigation.

                 Before parting with this order, it is pertinent to mention that the complaint has not been decided within the prescribed period of limitation of time. The history of the proceedings shows, firstly, the opponents delayed the proceeding by not concluding evidence in time and then, COVID-19 came into the way of this Commission and after the dip in the COVID-19, the opponents again caused delay in concluding evidence and thereafter, adjournment was requested for final arguments by both the parties and thereafter, parties agreed to refer the matter to the Mediation Cell of the Commission and this process also consumed time. In this way, whatever the delay has been incurred, same was beyond the control of this Commission.   Assistant concerned who is doing the work of the Reader (as no Reader) is directed to make necessary entry in the relevant register/system with regard to disposal of the complaint on today. File be consigned to the records.
