Heard. Complainant alleged, he applied for tubewell connection in his name on 17.06.2010 by depositing security amount of Rs.750/- with the respondent vide receipt No.057383 dated 17.06.2010 Ex.C2 issued by the respondent, but the respondent have not responded by not releasing his connection or rejecting the same, which is act of negligence, deficiency in service on their part.
The complaint has been instituted on 14.09.2022. On receipt of security amount from the complainant on 17.06.2010, no doubt, the respondent required to act within a reasonable period of time either accepting the application for connection or rejecting the same. At the same time, if the respondents had not acted in any manner within a reasonable period, question arises, why the complainant remained into slumber for the period of more than 12 years. The respondents remained into inertia and similarly, the complainant also remained into slumber. This Commission do not agree with the contention of the counsel for the complainant that the cause of action in favour of the complainant is recurring one. If the respondent remained into slumber for beyond a reasonable period, then, the complainant was required to come earlier, not exceeding the period of 2 years from the date of deposit of security with the respondent. Law helps those who remain vigil towards their rights, but not to the person who remains into inertia or in slumber. The complaint has been filed at highly belated stage and is liable to be dismissed on this score only.
Hence, the complaint is dismissed, it being barred by period of limitation of time, leaving the complainant to bear his own cost of litigation. File be consigned to the records.
