It is pertinent to mention first time, the death of the complainant was pointed out to this Commission on 18.10.2021 and till date legal heirs of the complainant have not come forward to join the proceedings. There must be an end to everything because for joining the legal heirs of the complainant, proceedings cannot be adjourned for an indefinite period. More than sufficient time has already been availed on behalf of the deceased complainant for the purpose of joining legal heirs and in the absence of joining of legal heirs of the deceased complainant, counsel for the complainant cannot represent the deceased complainant, because movement complainant expired, his Vakalatnama stood terminated. Under the circumstances, without commenting any on merit of the case, the proceeding initiated on behalf of the complainant since deceased are closed, may be revived, on appearance of Legal heirs of deceased complainant, on affording an opportunity of being heard to the respondent. File be consigned to the records.
