ORDER

Jahid Hssan vs. UHBVNL

Ex. No. 40 of 2017.

 

Present: Sh. Dharamvir Singh, Advocate, counsel for DH/complainant.

 

                        Today the present execution was fixed for consideration on the point of admission. From the perusal of order/judgment attached with this file, it is evident that the complaint bearing No. 211 of 2008 was decided on 03.12.2009 in which the following order was passed:

“In the interest of justice, the Nigam is at liberty to remove the meter in question and will send it to M & T Lab for checking the accuracy of the meter and after checking of the meter, the respondent will install the new meter in the premises of the complainant at their own expenses. the respondent after obtaining the checking report from the laboraty will overhaul the account of the complainant on the basis of six months consumption of new meter. The complaint is disposed of accordingly”.

                        Now the present execution has been filed after a period of near about 7 ½ years by the complainant. No application or any representation has been placed on file by the complainant showing that he ever approached to the OPs Nigam after passing of the judgment on 03.12.2009 for complying the order/judgment. So, we are of the considered view that at this belated stage after a lapse of 7 ½ years, the present execution is not maintainable and the same is hereby dismissed. However, the DH/complainant is at liberty to approach the Ops Nigam if  any grievances remains as per judgment. File be consigned to the record room after due compliance.
