ORDER

C.C.No.192 of 2017.

Jagpal Singh Vs. UHBVNL.

Present:      Sh. Joginder Kumar, Adv. for the complainant.

                   Sh. Balinder Singh, Adv. alongwith Sh. Ilem Singh, SDC for the Ops.

 

                   Today, the case is fixed for evidence of RWs.  Ld. Counsel for the Ops tendered in evidence affidavit, Annexure-R1 and closed evidence. 

                   Ld. Counsel for both the parties stated that they have reached at compromise.  Statement of both the parties recorded.  Statement of ld. Counsel for the Ops alongwith Sh. Ilem Singh, SDC recorded to the effect that the old meter i.e. domestic meter bearing account No.ML320875 about which there is dispute, will be sent to M & T laboratory for its checking about its accuracy as per rules and after the receipt of report from the laboratory, the account for the disputed period shall be overhauled accordingly as per the report received from the M & T laboratory.  It is further stated that in the meantime new meter shall be installed at the site and electric supply shall remain continue without any interference and the complainant shall deposit usual charges regarding installation of new meter.  Statement of ld. Counsel for the complainant recorded to the effect that in view of statement made by ld. Counsel for the Ops, he withdraws the present complaint and he is ready to deposit 40% of the disputed amount upto September, 2017. 

               Keeping in view the statements made by both the parties, the complainant is hereby directed to deposit 40% of the outstanding/dues upto September, 2017 within 15 days from the date of order.  However, the complainant is also liable to pay the outstanding amount, if any becomes due after receiving the report of M & T lab and overhauling the account of complainant.  The present complaint is hereby disposed of accordingly.  Both the parties are bound by their own statements.  File be consigned to record after due compliance.
