                                                DISTRICT CONSUMER DISPUTES REDRESSAL FORUM, JAJPUR.

O R D E R  DT. 06.12. 2014.

                        The record is put up in the Second National Lok Adalat. The  advocate for the complainant and  O.Ps are present.

                        Inflated bill is the grievance of the complainant. Hence, the complainant prays before this Forum for revision of the average / load factor bills  for passing necessary order as deemed fit and proper.

                        The O.Ps have refuted the allegations made in the complaint petition. A new meter to be installed by the O.P. immediately as the current meter is defective. If the current status will be not OK no revision will be undertake as per the NESCO guide lines. We were ready to install a new meter immediately during March-14.

                        There was no dispute during July-05 to December-2011 as the billing was on the basis of actual consumption.

                        After installation of meter the billing drawn during Jan-12 to the date of installation of meter will be revised as per section 97 of OERC Code.2004.

                        The billing done during August-01 to June-05 will be revised with IR= 1749 and FR=12358, resulting average= (12358- 1749) / 47 = 226 units / month.

                        Heard both the parties. Taking into consideration of the facts of the case, we disposed of the case :-

 

                   The ledger copy of the consumer reflects that there was actual bill up to July-01 when the consumer  was only arrear of Rs.6,342.00 . But at the end of April-05 the arrear rised  to 25,513.79. The reason of rise in arrear though non payment of current dues but it is not true. The meter reading some times became High and some times became low. Again meter status became negative and some time meter status declared to be defective. Then there after meter status was declared to be O.K and then defective  during August-01,April-05. During July- August-05 the new meter bearing no.3987085 was installed and 34 units was billed during that period . In our opinion the bill of the consumer should be revised from August-01 to August-2005 on the basis of average consumption of September-05 to February-06 as per Section-97 of the OERC Code-2004. Again the O.Ps. are directed to install  a new meter in the premises of the complainant. The O.Ps. are directed to revise the load factor bills of the complainant from January-12 till the installation of the new meter as per section-97 of the OERC Code-2004.
