Present appeal has been filed under Section-27A of the Consumer Protection Act 1986 against impugned order dated 08-08-2016 passed by District Consumer Forum, Basti in Execution Case No. 48/2015 Arvind Kumar Singh V/s Branch Manager, State Bank of India, Main Branch Basti and another.
We have heard Sri Arun Tandan, learned Counsel for the appellant and perused impugned order dated 08-08-2016 passed by District Consumer Forum, Basti in Execution Case No. 48/2015 Arvind Kumar

Perusal of impugned order passed by District Consumer Forum, Basti shows that District Consumer Forum had issued R.C. for Rs.1,16,000/- against respondents of this appeal in execution of judgment and order dated 25-05-2015 passed by District Consumer Forum, Basti in Complaint Case No. 51/2008 Arvind Kumar Singh V/s State Bank of India and another whereby District Consumer Forum, Basti has passed following order.
“ परिवादी का परिवाद स्वीकार किया जाता है। विपक्षी संख्या-1 को निर्देश दिया जाता है कि परिवादी से पत्राचार करके इस बात को स्पष्ट करें कि परिवादी पेंशन पाने का अधिकारी है अथवा नहीं अगर पेंशन पाने का अधिकारी है तो पेंशन भुगतान करने की कार्यवाही सुनिश्चित की जाये। साथ ही साथ विपक्षी संख्या-2 को निर्देश दिया जाता है कि वह अपने स्तर से विपक्षी संख्या-1 को निर्देशित करें कि परिवादी अवयस्क होने की वजह से पारिवारिक पेंशन पाने का अधिकारी है। विपक्षीगण परिवादी को हुयी शारीरिक व मानसिक परेशानी के लिये क्षतिपूर्ति के रूप में रू0 5000/- (पॉंच हजार) एवं वाद व्यय के रूप में रू0 3000/- (तीन हजार) का भुगतान इस आदेश की तिथि से 30 दिन के अन्दर कर दें। ‘’
Vide above impugned order passed by District Consumer Forum, opposite party no.1 of said complaint State Bank of India has been directed to assess as to whether complainant is entitled to pension or not. If he is entitled to pension then payment of pension shall be made to complainant. Until it is ascertained that complainant is entitled to pension, no recovery may be issued by District Consumer Forum for realizing pension amount.
In view of above fact the District Consumer Forum has recalled R.C. issued for realization of pension amount also. Perusal of impugned order shows that District Consumer Forum has not decided execution case finally.
In view of above, appeal is dismissed with liberty to appellant to move application for execution of judgment and order dated 25-05-2015 passed by District Consumer Forum in above complaint in accordance with law. If such application is moved before District Consumer Forum,

the District Consumer Forum shall pass appropriate order in accordance with law.
Let copy of this order be made available to the parties within 15 days positively as per rules.
