Dhr. is absent without any step and on repeated calls. But the Jdr. is present and also by filing the original statement of account vide BM/56/53 dt. 17/5/10 stating therein that on 14/5/2010 they have deposited Rs. 7366/- and further on 17/5/10 Rs. 38.35. Total decreetal amount in terms of order no. 19 dt. 1410/09 in CDF/Unit-1/Case no – 232/2007stands at the figure of Rs. 7000/- which was required to be paid positively within 30 days from the date passing the order dt. 14/10/09. But as the Jdr has incurred delay for certain time he has paid in total Rs. 7404.35/-. Said in other word for the delay in payment the Jdr has paid interest to the extent of Rs. 404.35.

As the Dhr. remains absent for consecutively 3 days inxlusive this day and more particularly when the Jdr has fully complied with the direction with regard to payment contained in order no. 19 dt. 14/10/09, in that event we dispose of this case on full satisfaction as full and final payment.
