                   Heard, Mr. Shiv Mohan Saha advocate appearing for the appellant.

We have the same and substance advised on behalf of the appellant is to the effect that the action of the bank in charges that the interest over loan dues is not correct. It is not in dispute that bank has received proceeding before the D.R.T, Patna, vide Appeal no. 362 of 1997 where the liability is to be determined. This impugned order is dismissed complaint case no. 77 of 1997 calls for no interfering.

        In the result appeal stand dismissed at the admission stage itself.
