Final Order / Judgement

            Petitioner has moved this forum praying for withdrawal of the bill dt.16.5.07 issued by o.p. and other consequential relief.

            It is alleged that the petitioner received a SBI Card being no.4006-6760-1474-5718 but he did not use this card. the expiry date of the card was September 2006. Petitioner  by letter dt.2.9.06 cancelled the card  in spite of the fact bill was sent on 16.5.07 demanding Rs.5006.57 although petitioner did not use the card.

            Notice of the consumer complaint has been duly served upon the o.p. Ld. Counsel for he o.p. appeared. Today also  ld. Counsel for the o.p. is present but no w/v is filed challenging the contention of the petitioner.

            It is further appearing from the bill dt.16.6.07 submitted by petitioner in course of hearing the amount Rs.506.57 has been reversed. It is evident from the record that due to deficiency in service on the part of the o.p. the demand was made to the petitioner on 16.5.07 although petitioner did not use the card issued in his favour. Consequently,  o.p. reversed the amount. Thereby it is apparent on the face of the record o.p. committed deficiency in service in providing service to the petitioner. The consumer complaint accordingly succeeds and petitioner is entitled to relief. Hence is is awarded in the following terms.

            O.p. is directed to cancel the credit card being no.4006-6760-1474-5718 within one month from date, failing which o.p. shall liable to pay damages to the extent of Rs.50/- per day. O.p. is also directed to pay compensation Rs.500/- (Rupees five hundred) only and litigation cost Rs.200/- (Rupees two hundred) only  within one month from date, failing which it will carry an interest @ 8% p.a. till realization.

            Let copy of this order be supplied to the parties free of cost.
