ORDER

1.    Heard learned Counsel for the Parties and examined the record.

2.    The matter pertains to dismissal of CMP No.264/2022 seeking Condonation of delay of 33 days in FASR 792/2022 and dismissal of FASR 792/2022 vide order dated 27.02.2023 on account of non-appearance of the Petitioner. 

 

3.    The learned Counsel for Petitioner states that he could not appear for hearing on 27.02.2023 due to personal reasons and regrets the same. He pleaded that, unless the matter is heard by the learned State Commission on merits, the Petitioner would be subjected to gross injustice and irreparable hardships.

 

4.    Learned counsel for the respondents contended that the dismissal of the Appeal is due to negligence of the Appellant Petitioner and thus the order of the State Commission is just and proper.

 

5.    We have examined the records and rendered thoughtful consideration to the submissions made by both the parties. Considering the facts and circumstances of the case, in the interest of justice, subject to the Petitioner paying Rs.25,000 to the Complainant (Mr. S. Vasudevan) within a period of four weeks from the date of this order, the impugned order of the learned State Commission dated 27.02.2023 in CMP. No.264/2022 and FASR 792/2022 is set-aside. The CMP No.264/2022 and FASR 792/2022 are restored to its original

number.

6.    Both the parties are directed to appear before the learned State Commission on 29.10.2024. The Petitioner is also directed to submit proof of payment of costs made to the Complainant/ Respondent on that date. The learned State Commission is requested to consider the case as per law.

7.    Revision Petition No.1880 of 2023 is accordingly disposed of.

8.    All pending Applications, if any, also stands disposed of accordingly.
